Two men are partners with a 60-40 profit split. One man gets sick and his wife becomes power of attorney for the partner NOT sick. Is original contract still valid ? Does wife become partner ? Does it null and void original contract ? Keep in mind wife does not let partner know she has power of attorney during the sickness.
The wife has the right, subject to the Power of Attorney, to represent her husband. It gives her no ownership right but does give her decision making. Should the partner die, his or her will would control his or her interest in the partnership.
"One man gets sick and his wife becomes power of attorney for the partner NOT sick." As written, that sentence makes no sense. How can the sick man appoint the sick man's wife to act as the agent for the man who is not sick?
"Is original contract still valid ?" What is in the original contract? For example, if the contract is that each person must provide personal service, then a person cannot appoint someone else to provide the service.
You can review the specific facts, including the contract, with attorneys to find out the legal options.
