Contempt of court if non custodial parent just went on unemployment ? I have 18 months of medical bills that have accrued that I paid in full, plus arrears in support I am owed. Ex just went on unemployment because he is claiming his work is seasonal. Will court find him in contempt if he just went on unemployment ? He had a steady 2 year string of employment
Did you have an attorney that represented you or your husband in the divorce? Are there any court orders in place regarding support? Regardless of contempt for being on unemployment, you should contact your state's child support division to discuss the status of the payments in arrears.
It is hard to tell what happened here or how someone ends up in contempt of court unless a court order was not followed. good advise from the other counsel.
Contemp is the willful violation of a known court order. The purpose of contempt is not to punish him for behavior, but to coerce him into doing good behavior - follow the court order. If he can show that he is unemployed and does not have the ability to pay, the court will not find him in contempt.
