I lived with my girl friend, for 2 yrs off and on but we have been together for 10 months Co-habitating, we told and filled out paper work for each other and we called our selves spouse. For 2 yr do I need to divorce her to get half of the property we purchased together??
Most likely you need a divorce. It appears you and she agreed to be married, held out to others that you are married and cohabited in Texas after so agreeing.
Common law marriage is very dependent on the facts, so please talk though your situation with a lawyer to get an opinion base on your full story.
While I appreciate the opportunity to weigh in on your question, I am not your attorney. I base my response on the limited facts you provided. A consultation with a family law attorney in which you discuss the situation in more detail is the best way to determine your legal rights and liabilities. I recommend that you consult with an experienced family law attorney in your county to get advice specifically tailored to your circumstances. In Tarrant County, please call to consult with me.
