A neighbor of a friend heard the neighbors next door to his parents talk down of deceased brother. After saying something the guy walk down the street to be disrespectfully confronted by neighbor who wasn't telling him anything. Now without talking about it he & his wife just call the police. Afterward my friend accidently flung a sandwich loose in his hands on his property . My friend walked away after a few steps attacked him from behind. He has asthma telling him to get off. My friend had to punch him to get him off his wife filmed on her phone about what happened afterwards. Protective speech. The cops came talk to everyone yet the neighbors filed civil restraining order against my friend. The neighbors won the case, judge was so bias on their side. should my neighbor file Battery charges against neighbor for jumping him? His parents live next door to these people in which they have no respect for his 88 & 85 year old parents. What could be done? This is California.
Only the DA can file charges. Your friend could report the alleged battery to the police. Alternatively, perhaps everybody could try to grow up. This isn’t a big deal.

When the judge granted the restraining order everybody "won." The judge wasn't biased - he was the only adult in the room. You can report this to the police if you feel you must and if they are polite they won't roll their eyes until after you leave.
