Can I file torts against my former Public Employer, under section 815.6? Negligent misrepresentation on the part of my attorney, do I file this complaint with the same case I have ongoing in court now? or is it a separate complaint?
You cannot strike your own complaint. You could possibly file a first amended complaint or file a motion for leave to file an amended complaint. Whether you can add defendants would require a consultation with an attorney in your area who can review all your documents. Do that or you risk losing out on some of your claims.
