I was in a parking lot with a small amount of weed and a grinder. I had not smoked any. I was approached by a police car and cited for possession of marijuana and drug paraphernalia and given a court date. What can I expect? Will there be a drug test at any point?I have no prior offenses on my record.
The drug paraphernalia charge is a petty offense and only carries a fine of up to $100 and no jail. The marijuana charge is also a petty offense and does not carry any jail, but carries a $100 fine and a drug surcharge. So, you are thankfully not looking at jail or even probation in all likelihood. However, I would advise you that many colleges and employers look at all of your criminal history, even petty offenses. Convictions for these charges might impact future employment, schooling, and possibly even apartment or house rentals.
My colleague is right it appears that both charges are petty offenses and carry fines, if you are written into municipal court you could be placed on probation potentially. There usually will not be any drug tests until and unless you are placed on probation or some sort of pre-trial supervision. It probably makes sense to speak with a criminal defense attorney so you can keep your record as clean as possible.
