My children's dad and I were never married now separated both children live with me he pays weekly child support he will be coming into a large personal injury lawsuit soon am I entitled to ask for and increase in child support once he settles? Ty
If he is working and was working during the time of the personal injury claim then I don’t believe you’re entitled to any increase in child support. Some personal injury claims result in someone being unemployed for a great period of time. Under those circumstances when they settle a mother with children that his an outstanding child support arrearage is entitled to get repaid. But I don’t see that applying in your case based on the little background info that you posted.
