Child support= OK attorneys i felt the last question didn't feel comfortable with it. So basically the ag office served me to go to court. Cause i am so behind on child support they asked me to bring birth cert to all my kids that mi supporting and i bring check stubs so i am not making enough so the atty i had wasn't helping me at all basically 3000 out he door. So cause he had an election he was campaign. So they stuck me on a 2 yr probation and making me pay 700 a month. So i am behind like 17000 like i said i doing all i can to take care of my kids. So i got 4 months left. My regular payment wore 480 a month tat i don't mind paying but put me and my family behind. So when my probation is up can i ask the ag office for a decease cause 700 i cannot do it. Can some help me
You can file to modify individually the court orders for your different children by different mothers in the separate cause numbers. A lawyer needs to check the ordered amounts and your present resources and figure out which cause to file to modify first. So the lawyer you had could have defended you against the enforcement but you had a separate matter of needing your orders reviewed for comparison with guidelines. Medical support is a separate part of each case. You need family law counsel, perhaps a different one. I cannot tell that your retainer was wasted if you managed to stay out of jail though perhaps the payment arrangements are too onerous. With interest of 6 percent the order must do more than cover interest or principal is never reduced.
Unclear if you are trying to lower the current child support or address the total payment due each month? Unclear what motion you have been served with, is it a modification or a motion to revoke your probation? Either way, make sure you appear in court and bring proof of your income. Also bring proof of any other biological children you have a duty to sipport. It may be worth setting up a consultation with any attorney for them to review the court file and disucss with you your legal options. The payment plan of the child support arrears remains until the judgement is paid in full. If you have an upcoming court date, you need to negotiate different terms for repayment.
