A commercial Tenant files for Chapter 11 and assumes its lease with Landlord. Some time later, Tenant defaults and wants Landlord to terminate the lease, or reduce monthly payments. If Tenant defaults, can Landlord pursue the remaining amounts due under the lease (post petition, post assumption amounts) or is Landlord now an unsecured creditor subject to the Tenant's bankruptcy?
Landlord can pursue tenant but only after receiving relief from the automatic stay. Landlord should file a Motion for Relief from Stay.
