Without the other parent’s consent you will need to file a motion for name change with the court and prove to the court why its in the child’s best interest to have the child’s name changed.

If you and the baby's father agreed on the baby's name, then you not going to be able to change the baby's name. If you and he did not agree, then you can include in your action for custody and child support that the court change the baby's name to a name that you believe is in the best interests of the child. If you have not already done so, you would be well advised to meet with an attorney.
