Entered United States on May 19'2016 on H4 visa. Visa Stamped in US Consulate in India.
Filed I-765 on May 20'2016 based on H4 status on entering US on May 19'2016
I-539 denied on May 27'2016 as applicant departed United States on May 09'2016
My question is:-
I have a valid H4 status when i entered United States on May 20'2016 and filed my I-765 based on that status (with an approved I-140 of spouse).
Do i need to do anything for this denial of change of status application??
Can this impact my I-765 application??
You should be fine and assuming your spouse has an approved I-140 your EAD should be approved. The last action rule in this situation does not apply because the change of status was abandoned by operation of law when you left the US so the entry in H-4 status is actually the last act.
