I am on H1B and my employer sponsored for my green card and I got my I-140 approved and get a priority date. I am just waiting for my priority date to become current to apply for my green card and go for my interview.
But now I am about to get married to a US citizen in a month. Once I get married can I change my sponsorship from employer based to family based. How does that work. Should I start the green card process all over again or just an adjustment of status to my current petition/priority date would do. please help and also while doing so can I legally stay in the US and continue to work. Thanks.
If you will be filing for adjustment of status based on marriage to your U.S. citizen spouse, then the I-130 relative petition must either be approved or accompany the adjustment of status application, among other applications and supporting documents.
The I-140 approval notice is is not applicable but it can remain as a "backup" option in case there is a problem with the marriage sponsorship.
