When I'm filling documents to the court through e-file portal electronically, and select the other party email for delivery as well ,so they can receive all the papers, do I still need to attach certificate of service? If so do I need to say that the party was selected for e-filing or mention their email?
You would have proof of electronic service but all your documents should also have the required certificate of service saying you served the other party electronically. It’s the rule, so although it seems duplicative, it’s best to comply and avoid any complaint that you are not following the rules. If the other side is represented by an attorney you can bet they will call the court’s attention to any infraction on your part. If you have the financial ability to do so, I would suggest you hire an attorney so you don’t have to worry about these kinds of issues. Good luck.
