My name is Aaron Kyles, and i were injured hauling Flat-Bed OTR. I had two Disc Replacement in my lower back, and i just learned(10 years later) that the surgeon also Fused three entire location, leaving my in horrible pain. I also had a Right Wrist Surgery. I was given a Medical Set-Aside for future treatment but it was structured and given to a company to administer ate a very small amount per year. I need to have the funds released to ME. I also have a separate MSA from returning to work and having to have 3 Fusions in my Cervical Spine and left Shoulder(Rotator Cuff-Bicep Muscle Repair) and neither Surgery wee successful and i have another MSA that was structured once again. Can anyone help me get my monies released to ME
Those are not to be released so much as paid to reimburse Medicare.

If you hade an work comp attorney handle this for you, contact him or her to see if they can help. If not, you may need to contact the annuity companies that are administering the MSA funds, explain you need to have surgery and need the funds released or contact Medicare to advise that you are in need of surgery, the annuity per year from the Medicare Set Aside is not sufficient to cover the cost, and see if they will pay the difference between the annuity amount you have so far and the cost of the surgery. Your Medicare set-aside,s can only be used in accordance with the terms of each one of these as to what they specifically relate to the injuries sustained in each of your claims. I don't know of any way that all the funds can be released to you without you itemizing for Medicare those bills that you pay.
