I received a summons to court 5/15/19
About cavalry spv LLC purchasing old credit card debt from Citibank where I was on medical hardship and last payment was 11/17/13. We think this is one that settled with us and sent us a 1099 to file for taxes. I'm looking for it now.do I need a lawyer to handle this?
You should retain an experienced MO litigation attorney to handle this matter for you. Use AVVO's Find a Lawyer tool to select a qualified attorney. Good luck. THIS IS NOT LEGAL ADVICE! YOU NEED TO SPEAK TO AN ATTORNEY WHO IS LICENSED IN YOUR STATE FOR LEGAL ADVICE. This is merely suggestions for you to think about in discussing your situation with the local attorney.

This sounds like what we lawyers refer to as zombie debt. An old debt that is coming back long after it was disposed of as a result of being sold to a debt buyer. These folks are not likely to be able to make a legally submissible case due to not having proper paperwork. However you will need a lawyer to be able to challenge it. The good news is that you likely can get an attorney without paying a large fee because there are several that handle these on a contingency fee basis. The reason they are able to do that is because these debt buyers routinely violate the Fair Debt Collection Practices Act (FDCPA). These violations are actionable and can result in you being awarded damages out of which your attorney gets paid. I strongly encourage you to speak with an attorney experienced with Zombie debt cases to get this resolved for you.
