Yes I should get over it all but can't control how I feel . I have been ridiculed and embarrassed by my husband his new girl post pics of them friended my kids on their social media with intent to harass me. Can I order a gag order on him and her until my divorce is finalized ? I moved out the state to get away from it all and we already had situation where she feels she has every right to disrespect me as a wife I feel offended that she can do what ever. My husb has a no contact order and I asked him out of respect to me to make the social media stuff they had dissappear and he did on However she has continued posting and publicly announcing their status out of respect I want a gag order is using this gag order ok in this matter he ordered a protective order hasn't been approved yet
Highly unlikely. I suggest that you have the children unfriend this person so you don't have to see this stuff. If your husband is also posting this sort of thing, bring it up at the injunction hearing. But, overall, yes, you're right, you just have to rise above their nonsense and move on. Clearly you're better off without someone like that.
This response is for general purposes only and does not establish an attorney-client relationship. You should contact an attorney to fully discuss your issues.
You are not going to be successful. There is no constitutional right to have an ex-husband and significant others bow to your wishes because of a particular sensitivity. Either ignore what they post or find some other way to cope.
The answers provided in this forum by me and transmitted by users of this forum are not to be considered legally binding in any way, nor is there an intent to form an attorney client relationship. If further information is required, seek competent legal counsel.
It does not appear likely that you would be entitled to a gag order as to the girlfriend. Involving your children is another matter, and you may be able to some time of relief. You can also use some self-help by having your children "unfriend" the offending party.
As most of the other lawyers have said, it is doubtful the divorce court has jurisdiction over the girlfriend because she's not a party to the case. If you have a lawyer you ought to talk it over with him/her. If you don't have a lawyer, I suggest you get one.
You are seeking a "gag order" but perhaps are really talking about a Protection From Abuse or Restraining Order. In New Jersey as I am unfamiliar with Florida, however, if that question were asked to me here, I would want to know more about the nature of the Facebook postings and whether or not they rose to a level of harassment or threats. Here in NJ, the victim would apply for a restraining order under the Prevention From DOemestic Violence Act.
