Can you seek Rehearing re a Petition for Write of Mandate that was denied by the Court of Appeals?
I'm assuming you mean a writ of mandate. No, you cannot, if it was summarily denied, which is what happens in most cases. The Court of Appeal can order rehearing only of a "decision that is not final in that court on filing." (Cal. Rules of Court, rule 2.68.) An order denying a mandate petition "without issuance of an alternative writ, order to show cause, or writ of review" is final immediately upon filing. (Cal. Rules of Court, rule 8.490(b)(1)(A).)
