I sold a vehicle on payments to a guy in July. He has came up with excuse after excuse to not pay me. Now he has wrecked the vehicle. We do have a notarized contact that if he missed 2 consecutive payments that the vehicle is mine. I wanted to know if i can report the vehicle as stolen since he hasn't returned it on his own.
It sounds like you have a simple breach of contract / agreement. You can't report the vehicle stolen because, simply put, it was not stolen. You were not the owner if you sold it to him, and unless you recorded a lien on the face of the title with the BMV, you would not be a valid lienholder either.
