My boyfriend did not complete his community service but all his fees are paid up. He was working and his work hours interfered with the community services hours. He is current in Harris county jail waiting to see the judge. What are the chances of him getting violated for this matter? And he has been in Jail for a month now as well.
Unfortunately the answer is yes. The judge has the authority to revoke a probation/deferred adjudication and sentence anywhere in the range of punishment for ANY probation violation. That's the bad news. The good news is that the DA's have to prove that he violated. The even better news is that if you are able to hire a good criminal defense attorney to represent him who is familiar with Harris County practice, then he may have a good chance of being reinstated and not sentenced to prison. It's not entirely clear, but it sounds like you're referring to a deferred adjudication for for a second degree felony. Where a defendant falls to satisfactorily comply with the terms, and complete the period of deferred adjudication, the court can adjudicate the case and sentence the defendant.
