Can you file the First Amendment complaint without leave to amend in District Court?
The opposing side, is saying they have not been served properly, that they're not the authorized entity to be contacted. They are trying to squash service.

What do you mean by foreclosure lawsuit. Do you mean you’re trying to stop a for closure by your bank? Thanks for closures in the state or non-judicial so there wouldn’t be any court case. And then the first amendment has nothing to do with any of it and if they’re trying to quash (not squash) service it’s because they’re not the correct party—as they are saying. You have to figure out who you should serve...assuming this is a valid lawsuit at all
