Back in 1980s arrested as a group for possession of marijuana. Went into court and judge ordered me to pay a fine. Paid $100 fine, it is considered an violation. But now trying to see if I can have this removed off record for immigration purposes, because New York does not have expungment.
You can file a 440 but what is the legal basis? What violation did you plead guilty to.
I am a former federal and State prosecutor and have been handling criminal defense and personal injury cases for over 19 years. The above answer, and any follow up comments or emails, is for informational purposes only and not meant as legal advice.
Expungement wouldn't work anyway for immigration purposes. Get a certified copy of the record and disposition and consult an immigration attorney to discuss any immigration ramifications.
