My current boyfriend was sued by his ex in the divorce 15 yrs ago for his pension. She is remarried and the children are grown. My boyfriend retired in August 2019 and She now gets 700 a month and my boyfriend is left with 18 dollars a day to live on. Can we contest the amount she gets and does her being marry weigh into that?
No, and no. His retirement was an asset and it was a divided in the divorce judgment. That judgment is done and cannot be changed. I have no idea why he hasn’t got enough money to live on, but this is not going to be changing.
This is general advice. You are anonymous. If you PM me i won’t know what it’s about.
They divorced 15 years ago. Ex -wife's benefit is the result of a court order; likely a Qualified Domestic Relations Order. It is also likely that the QDRO and the judgment that was entered 15 years ago were both stipulated to by the parties. I can't imagine a legal or equitable basis on which he could set either aside at this point. $18/day? aka $540 per month? Why is that his only source of income? There's information missing here.
