Can you be trespassed from public property?
I was simply parked in a public parking garage provided by Wake County for the public to park when I was asked by security for the parking deck to leave . They wouldn’t provide any reason. Later, police arrived and wasn’t provided a reason by security as to why they wanted to me leave but insisted on carrying out the security’s wish. Today, I sit here clueless as to why this even transpired and how someone can be trespassed from public property (ie: Court House, Police Station, City Hall).
You were told to leave. You didn't. That is the literal definition of second degree trespass. You do not have a right to be on property that isn't your own. Quit acting like you are puzzled about how you met the definition of trespass and hire a lawyer to try to get it dismissed. If you were not causing a scene, there may be a way to work out a good ending to this story.
Depends on the details you left out---no one has permanent unrestricted absolute access to park indefinitely---police likely have a different version of events
Please do not send me a DM or email with follow-up questions. If you need an attorney's assistance search locally by calling your State Bar Association or try the "Find a Lawyer" link at the top of the page. I answer questions on Avvo in my spare time as a public service. Unless we have both signed a formal retainer agreement you are not my client, and my discussion of issues does not constitute legal advice. No attorney client privilege is created by this or any other response on Avvo. Answers are anchored in general legal principles not state specific law. I am an attorney-at-law licensed in the Commonwealth of Virginia and Federal Courts. For specific responses on your specific issues and the laws in your state, you need to speak directly with an attorney in your own state. The answer to “speak with a local attorney about all the facts and details” is proper and correct in every situation posed on Avvo. All the best to you.
