I was charged with a 3rd offense DUI within 10 years and A refusal to blow second offense. I have never been convicted of a first offense refusal before so I am completely lost as to why I was hit with a second offense refusal if I have never been convicted of a first offense. I took it to trial and was found Not Guilty of the 3rd offense DUI but was found Guilty of a second offense refusal. My license had been administratively suspended a year before trial and after trial was finished they suspended it for 3 years more on top of the 1 year it was already suspended administratively . I have 2 more years left now I have already petitioned the court my self earlier this year of 2020 and was denied . So my question is , is there anyway I can get a restricted license just for work? and was I charged with a second offense because the grade of the DUI ?
You may have to consult a criminal defense lawyer and file a motion for reconsideration.
