Hey all. My boyfriend is currently incarcerated in Lancaster County Prison on a PV. The charge took place in Camden County and he was arrested and served 2 months there. He then had a Pre-Indictment Conference and took a deal of a two year probabtion. He has to return to court for the official sentencing this Friday. The problem is after he was released from Camden County, Lancaster picked him up on the Violation. He has a release there of January 9th. So obviously he will miss the sentencing. He has contacted his lawyer and she said that she would try to get them to get him down for court but she claims that all they will do is put a detainer on him after he is released but Camden will likely not come get him.. Which means after 10 days Lancaster will have to release him. We know that a warrant will likely be put on him but we just want to postpone the sentencing until after his release. Is there a way we can do this? I am trying to contact anyone... I think being incarcerated is a damn good reason for postponement... Especially cause it all stems from the same charge!! Any help please!!
Your boyfriend's attorney can explain to the judge that he is incarcerated and ask for an adjournment. Shouldn't pose a problem as this isn't the first time this happened with a criminal defendant.
It doesn't matter if you think its a good reason or not. Some judges would take the exact opposite stance if someone gets picked up between plea and sentence actually.
