I have quick quesion h1b extension. Say on March 20th I will be eligible to apply h1b extension (6 months before my current h1b expires). Can we file LCA before March 20th and if approved be ready to file the h1b extension on March 20th?
Do we need to file LCA only March 20th and wait till gets approved and then file h1b extension?
There is a way to file the LCA ahead of needed time but this question should be posed to the attorney of record fronthe emoloyer to ensure forms are correctly completed for the desired result.
Yes it may be possible, speak with your employer's immigration attorney.
Attorney Robert Brown's (former INS Director, 1972-99) reply to your question is general in nature, and does not constitute legal advice as all facts are known to him. For specific advice or representation you should retain an attorney experienced in immigration law. Mr. Brown's reply on AVVO does not create an attorney/client relationship not constitute legal advice.
Reach out to the company counsel. If your company cared to hire an experienced attorney, they know.
