We adopted my niece when she was 5 yrs. Old she is now 17 yrs. Old she has put us through hell the last 12 yrs. She tried to commit suicide by drinking antifreeze & has been in a psychiatric hospital for 7 days & they are wanting to release her but we feel she is still a danger to herself & our family. If we don't pick her up when they discharge her & CPS has to place her in foster care can we be charged with abandonment or any other criminal act?
No. You will not be charged with criminal abandonment.
Allow CPS to take control and place her.
If the facility seeks to discharge her and you refuse to pick her up likely.

I would suggest that you contact a family law attorney and preferably one who has some experience with the DCF system as soon as possible. Best of luck to you.
