I have lived here 4 years and been complaining constantly about serious repairs such as the electric wall heater will not turn off in the bedroom and the bathroom fan does not work at all and there is no window in the bathroom so it causes mold and moisture, and the paint is peeling in the bathtub and in the kitchen and the cabinets are literally disintrigating, and the rent has been continually raised each year and they have not made the repairs, i finally found out i could complain to the apartment communities corporate grievance dept. , they had a lawyer contact me for info bit have not completed repairs still so i complained again because it has been months. Now i got a 3 day notice to pay or surrender on the door today march 2nd and they dont even charge their outrageous $75 late fee until the 4th of the month and it states in the lease it i not late until the end of business day on the 3rd of the month. I haven't been able to move because i cant pay the rent here and save to pay the 1st month rent and deposit somewhere else move. Can they give me the 3 day notice to pay early? I feel like they are harassing me.
This depends on the reason the 3-day notice was issued. If the Lease specifically states you have until after the 3rd, and the reason on the notice is for failure to pay rent, then the answer is no. The Landlord was early, and he or she would have to issue another 3-day notice after the 3rd. If the 3-day notice is for a different reason (ie. violation of some other part of the lease) then it doesn't matter what day it is issued.
