Child support is calculated by a formula based on your gross income and mother's. It is pretty simple math, and the resulting calculation will usually be the amount. When you became unemployed, you should have sought modification to reduce the amount. But now you've piled on arrears, and whatever the new calculation for support is, you'll likely have the $50 per month added to apply towards the arrears.

TO QUESTIONERS FROM WV & NY: Although I am licensed to practice in your state (in WV, on inactive status as of 9/13), be advised that I practice on a day-to-day basis in Massachusetts. I answer questions in your state in areas of the law in which I practice, and in which I feel comfortable trying to offer you assistance based on my knowledge of specific statutes in your state and/or general principles applicable in all states. Being licensed to practice there, does not confer detailed knowledge of local procedures and practices which comes from day-to-day work. It is always best, however, to work with attorneys and court personnel in your own area to deal with specific problems and factual situations.
