Is it possible to take out my husband’s name from his ex’s child certificate? They met when she was already pregnant and the biological father never wanted anything to do with the baby. My husband and his ex broke up when the baby was ~3 months old. They’ve never married, the kid is already 4yo and he has no legal obligations or had any contact with neither of them since they broke up. Now she is engaged and we would like to know if we can apply to get his name removed from the birth certificate.
It is not that easy. You need a court order to update the birth certificate of a child with Divison of Vital records. Speak with a family law attorney who can walk you through the process.
My answer is for general informational purposes only and is not a substitute for a personal consultation with a local attorney with full case details.
