Father has threaten to keep the baby when he visit and says there’s nothing I could do if there’s no court order? Is this considered kidnapping if he suppose to return her by a certain time? Is there something I could do so it won’t happen?
Tell him because of what he said you can't let him take the child from you without a signed written agreement that he will return the child at a particular time and place. If he won't sign or you can't agree, it is time to file a paternity case with the court to obtain temporary and later long-term orders on custody and visitation issues. It can help to have an attorney where there is a difficult parent on the other side, but many people cannot afford that and the court system has various ways of helping people who represent themselves in custody proceedings. The LA court website has information and is a good place to start.
....but it wouldn't be considered kidnapping unless he refuses to disclose the whereabouts of this child. It's his child too.
