I unfortunately owe restitution to the State of CA for a prison term & I'm currently paying. By law they can charge 10% admin fee to collect this debt. But they are charging me 25%. I had asked where the additional funds were coming since they only had a right to 10% they stated " We are only charging you 10% the other 15% is the fee the California Franchise Tax Board is charging you". I set up a payment plan because my bank account had been levied and I asked FTB about this fee and was told "We are not charging this fee to you. We charge CDCR a 15% admin fee to collect the money from you. " What CDCR had done was created fake case numbers by adding a letter or two on the end of the cases that the judge ordered restitution & that is how they are passing their fee from FTB to me plys 10% admin fee CDCR already added. This is completely wrong. The judge did not order me to pay anything beyond what he did. To pasd 15% on to me when the courts themselves do not charge any fees to debtors when referring the collections to FTB? I feel this may be a good class action suit against CDCR for abusing collection practices. Where do i find an atty willing to help me with this?
