Ok so bio mom has 4 kids. 1 my husband fathered from previous relationship. The other 3 all different fathers. One of the fathers is unknown completely. The bio mother is facing federal drug charges 841 (b)(1)(a) that carries a sentence of 10 years to life. All of the fathers are getting custody of their children and she is wanting to sign the rights to the little girl away( the one with unknown father) to is so we can adopt her and stay with her brother. Is this possible?
It is possible. Bio mother can voluntarily surrender her rights to the little girl to you and your husband. This may be a relative adoption, which is much less expensive than a non-relative adoption (neither adoptive parent related to the child). I cannot be certain without doing some legal research. If you have not already done so, you should consider adopting the other child your father had with the bio mother as well.
