I have completed 6 years on H1b and got an 1 year extension based on labor certification approval and the current H1b is expiring on Jan 2013 and will be applying for H1b extension in next few months, now that I have my I-140 approved last year, there will be no issues to file for an H1b extension up to 3 years from the same employer.
I want to switch the employer to upgrade the EB category from EB3 to EB2 and understand that I need I-140 approval notice (I-797) for H1b transfer. But I don't have I-140 approval notice from current employer but have copy of I-140 petition papers, I-140 receipt # from the current employer and Alien registration #......I wanted to know if I can transfer the H1b to new employer with these documents or I much have I-140 approval notice.
