The case was appealed following a nonsuit. Then the plaintiff lied in circuit court and said GD Court is who dismissed it. So that circuit court would be able to hear the case on a de novo appeal. But that was a lie the plaintiff is who took the nonsuit then the plaintiff appealed the nonsuit. I have the court papers that says it was dismissed on the behalf of the plaintiff. Now it's in appeals but it hasn't been heard yet. So how do I challenge jurisdiction regarding circuit court?
In Virginia, you can challenge subject matter jurisdiction at any time, even for the first time on appeal.
Be fully prepared for trial if your challenge to SMJ is denied.
