I am the Plaintiff in the matter. I am the Defendant went to Small Claims and sat with a Mediator and came to an agreement that I was not satisfied with but took it on the chin and agreed. The Defendant did not follow through with their end of the bargain after I did my due diligence on my end of the agreement for the Defendant. The Defendant gave excuses to me and then just refused to answer and not even make any payments so I got a Judgement for the full amount of the suit. I did a Writ of Execution and the Court Officer said the Defendant is looking to vacate I called the Court two weeks later and nothing has been filed. Is it even possible for the Defendant to vacate? I am not looking for a one word answer but more of a defined if possible answer please and thanks in advanced.
Until you receive a notice of motion to vacate the judgment issued or receive the order itself you should continue with your efforts at execution
