The guy who he hit isn't the one pressing charges. The prosecuting attorney is the one who decides to file criminal charges. The police took a report, and the prosecutor decided to charge your cousin based on the information contained in that report.
That doesn't mean that your cousin doesn't have a good defense in this situation. He needs to hire a good attorney who is willing to take the matter to trial.
