I think the controlling Supreme Court Case dealing with airspace would be Florida v Riley... I think Kyllo v United States would apply dealing with technology and expectations of privacy...
It will be fact specific and how high they were flying... if it’s determined public airspace or not... if it is unreasonable or not...
