Has he been convicted? Sentencing is based on lots of factors. Prior record, current offense, sentencing laws, probation recommendation, plea bargain, etc. You really need to discuss this with his atty.
A judge may take all circumstances into consideration at the time of sentencing, including your father's health, unless it is a crime which involves a mandatory, minimum sentence. But a person, no matter how sick or how old, can go to jail like everyone else. Talk to your attorney about presenting character witnesses, if allowed, at the sentencing hearing.
