I have a friend who is incarcerated in MD, charged with possession and drug paraphernalia. He is currently on PA State Parole. My question pertains to if he gets the charges dropped or reduced will he be able to avoid a violation for a new charge in PA? There is also a dash cam that should have recorded another person in the vehicle stating that the drugs and paraphernalia were his however my friend got the charges. He can not afford an attorney so I am trying to all I can to help him.
If your friend is convicted of an offense in what Pennsylvania considers a "court of record" (in Pennsylvania this would be anything above a Magisterial District Court) then he will be violated by PA State Parole as a "convicted" parole violator. . If he is convicted in what Pennsylvania would not consider a "court of record" in Maryland then State Parole most likely would not violate him although they would have the discretion to consider him what is called a "technical " parole violator.
