We have lived in the same unit for over two years and only in the last 8 months have we had damage to the apartment. Our youngest son, who is 9, has sensory issues as well ad Occupational Defiance Disorder. He is in counseling as well as going to a program to help with his speech and social skills. He became overloaded sensory wise four times and damage four doors. Last night, February 3rd 2018, our oldest son who is 18 decided to do a somersault in his room. He damaged a door and a small section of wall. Our Landlord has stated before that if they find any additional damage they would evict us. We got assistance with paying for the four damaged doors through the FAR program. We are willing to pay for the fifth damaged door and well as the repair to the wall. We have four children ages 6, 9, 14, and 18. We have no where else to move nor will we have to ability to move till our taxes arrive. Before our 18 year old Son damaged the door and wall we were looking at a possibility of moving into a house by either July or August. If we are evicted we will have to wait an additional year to get into a house and our children will most likely have to change schools.
As long as you fix the damage within the notice period from the landlord you should not be in breach of the lease. Keep the lines of communication open with your landlord and take steps to prevent future issues. Ultimately you are responsible to return the unit in the same condition you got it in, but a disregard for damage could be used to to show a breach of the lease or rental agreement.
