Kids are 4, 6 and 8.During his parenting time i call at 8pm to tell them goodnight, he records every call and remains in the room during our conversations. This has been going on for a year and my oldest is aware of him recording. Is this allowed
It is allowed so long as one party to the conversation is aware of the recording. Therefore, if your oldest child knows it's being recorded, that would be okay. Further, if your ex takes part in the conversation in any way, even answering the phone when you call, that would probably make it acceptable to a judge as well. Other than being annoying, I'm assuming that you have no reason to be concerned about his recording your calls -- knowing that he's recording should keep you from saying anything he could use against you, doesn't it? He certainly can't hold it against you that you say goodnight to the kids!
