If you were married to your wife when you earned any part of the pension you are referring to, then yes she can get a portion of the pension. You should go in person to consult with a divorce attorney who has expertise in this area. Whether or not she worked is not relevant to the issue of the division of your pension. Had she worked and earned a pension benefit, her pension would also have been divisible if earned during your marriage.
If your wife was married to you during any of the years that pension credits or contributions were made allows her,under Federal Law, to claim 1/2the marital portion of your pension.
