It is illegal in MA to record a conversation with someone unless both parties consent to the recording - meaning you would have to know about it in advance and voluntarily agree. It would still be hearsay in MA but there are exceptions to the hearsay rule such as if your statements are considered admissions then they may be admissible under that exception to the hearsay rule. Other states may use a one party rule meaning only one person in the conversation has to consent. Federal laws may also apply.
