We are both on the mortgage and title. Currently separated but still living under same roof until she moves to her new apartment in a few months before divorce is final. I will be awarded property once divorce is final. Does her rights of ownership override mine or what happens when both homeowners disagree on guests allowed in home?
Her rights do not override yours, and similarly, your rights in the house do not override hers. So the starting point is that you two are at a legal impasse as to house guests. If that's not agreeable, this is why there is a statute allowing courts to make temporary orders, such as use of a marital residence, while a divorce is pending.
It is your home too, and if you do not agree for her having someone live with her, boyfriend or otherwise, file a motion with the court commissioner to have her court ordered not to have everyone living with her in the homestead during the pendency of the divorce.
If you are concerned that her significant other may cause damage to the home, you can file a motion to modify the temporary order to prohibit his residing there while the action is pending.
