Ive established paternity and pay child support. I have not filed through court any legitimacy orders. Do i have full rights as a Father with the paternity established? She claims because we were unmarried she has full control and I essentially have no rights as a parent. Is this true?
Once paternity is established, you have equal rights. But the safest bet is to file for custody to have a Court assist in setting the parameters of custody and/or visitation.
She can continue to dictate visitation until there is a custody order in place. The order will specify your days/times with the child and if mom fails to allow that visitation she can be held in contempt.
If paternity has been established and you are both on the birth certificate, then without a custody order in place, both of you have equal rights to the child.
