My sister in law was painting at a church for her boss and was standing at an angle on a 8 foot ladder by cabinets of church when they came loose and fell hit her ladder and caused her fall and she has a broken elbow severely bursing to her ribs and back and has to see specialist for her elbow and her boss and preacher is aware of her fall and told her that the rain coming in the church is what caused the cabinets to come loose and fall on her its not reported on workers comp cause the boss said that the church was at fault due to cabinets being loose due to rain coming in and they were aware cabinets were loose now she has been off work due to fall cause she is a painter and her elbow is fractured! Can she seek after them for her injuries?
It sounds to me like she probably has a tort claim against the church as well as a WC claim against her employer.
The fault of the church does not diminish her WC rights.

There may be both a personal injury action against the Church and a workers compensation action. consult both legal specialties.
Each state has its own requirements for workers compensation insurance coverage for employers. Your employer likely has coverage. you should contact a Work Comp attorney in your area and they can advise you about the viability of a separate claim for personal injury. Do not delay there are reporting requirements for employers that are different in many states.
