I was out of work and got behind on rent ive payed what my rent totals plus what i thought I was supposed to be charged for late fees i.e 50 late charge then 5 dollars a day late charge. After I payed what i thought I would owe he told me I still owe 2300 beacuse he was applying my payments to late fees first. Also he was stacking the 5 dollar a day late fees so month 1 I was at 5 dollars a day month 2 I was at 10 dollars a day month 3 15 dolarrs a day month 4 20 dollars a day.
Can he stack the 5 dollar a day late fee it says nothing about that in our rental agreement it also doesn't say payments will go to late fees first. How can that be legal how are you ever supposed to pay it off lol I've payed him 6500 in 30 days beacuse of how he's applying my payment i.e to late fees instead of rent and compounding each 5 dollar late fee month to month ill never be able to pay it off. Theirs nothing in our rental conttact saying that's what he is or can do.
Late fees must be called out and specified in the lease. If there is no mention of the daily late fee in the lease he cannot add it. The fees do not seem reasonable and you should have your own attorney read the lease and write him a letter.
