My ex moved out 2 weeks after we moved into a new apartment. Both our names are on the lease. He moved 2100 miles away. Hes been gone months and is not coming back. Can i have my landlord take his name off the lease if i sign for full responsibility of the apartment?
You can certainly ask! Your landlord will probably want to do a financial check to make sure you can afford it on your own.
I have a private practice in Malvern, PA, and I welcome new clients. Contact me privately for further information. Prior to becoming my client, you will need to sign a representation agreement, and you may have to pay a retainer depending on the type of case. My answer to your question is not to be considered legal advice, just general information based on my knowledge and experience, and the fact that I answered your question does not create a lawyer-client relationship between us. That would have to commence more formally. Further information is at my website www.RabinLawOffices.com.
Not really, without his permission. Even 2000 miles away he has rights under the lease contract he signed. With that said, if he has been gone so long and has no intenton of returning, I would think he would be more than happy to sign something to terminate or amend the existing lease to get his name off.
