The parenting plan states that he gets the child every other weekend. He also gets him a week in June and July among other times. The problem we are having is this. we pick him up at the meeting place on a Friday and would generally return him on Sunday. This week we have him for our weekly July visit. Mom is trying to say that when we return child on Sunday, it will be another two weeks before we get child again, essentially cutting out one of his weekend visits. Parenting plan states that other than weekly visits, normal every other week visits are the same. So my questions are: 1. Do the weekends change because of a week long visit, and 2. Is this not Custodial Interference, and 3. Which county do we file the warrant with? The county we live in, the county mom/child resides in, or county where exchange is made? (They are all different). Thanks for your help!
Based on what you have posted, you do not have a case for custodial interference. However, you need a full assessment of your situation, and you do not need to post all the facts in a public forum. Accordingly, I suggest you sit down with an attorney for a consultation. Only then can you thoroughly discuss your matter and develop a legal strategy to resolve it.
